General terms and conditions of radiologie-weiterbildung.de GbR for online training courses
1. Offer
1.1. radiologie-weiterbildung.de GbR provides members of the medical associations, their staff and persons professionally involved with medical topics (hereinafter “participants”) with continuing education courses and online congresses in the form of live online lectures in accordance with the following General Terms and Conditions.
1.2. Online training courses are conducted via remote data transmission over the internet at a fixed time (date, time, duration) with moderators, speakers and participants present at the same time.
2. Conclusion of contract
2.1. Registration takes place via our web shop at www.school-of-radiology.com. In exceptional cases, registration may be made by letter or e-mail; radiologie-weiterbildung.de GbR decides on this. Registrations are binding even if the confirmation of registration does not arrive or does not arrive in time. In the event of overbooking, the participant will be informed without delay.
2.2. Upon receipt of the registration, the participant will promptly receive a confirmation of registration and an invoice for the participation fee from radiologie-weiterbildung.de GbR. Online payment systems are available to the participant for settling the invoice amount. The amount is collected from the participant’s account by the selected online payment system. Payment by conventional bank transfer is reserved for exceptional cases; radiologie-weiterbildung.de GbR decides on this. In this case, radiologie-weiterbildung.de GbR will send the participant an invoice by e-mail. The invoice amount, stating the invoice number and the participant’s name, must be credited without deduction to the account specified in the invoice no later than two weeks before the day of the seminar. For short-notice registrations, the invoice is due immediately.
3. Prices
3.1. The prices stated are gross prices.
3.2. Telecommunication and internet costs incurred by the participants themselves are not included in the prices.
4. Changes to the programme/cancellation
4.1. Necessary changes to the programme, e.g. due to illness of a speaker or for current reasons, are reserved.
4.2. radiologie-weiterbildung.de GbR reserves the right to cancel the online seminar due to insufficient demand or number of participants up to 10 days before the event date at the latest, or for other important reasons for which radiologie-weiterbildung.de GbR is not responsible, such as sudden illness of the speaker or force majeure. In this case, seminar fees already paid will be refunded. Further claims and claims for damages that do not concern injury to life, body or health are excluded, unless radiologie-weiterbildung.de GbR has acted with intent or gross negligence.
5. Access to the online seminar
At the latest on the day of the webinar, the participant will receive the access link to the online seminar by e-mail. The access authorisation may not be passed on to third parties, is non-transferable and may not be used for multiple logins. Access to the online seminar will only be activated on the day of the online seminar. The participant is responsible for providing the technical requirements necessary for participation in the online seminar. Where online training courses take place live, radiologie-weiterbildung.de GbR does not guarantee good transmission quality.
6. Rights/materials
6.1. The participant expressly acknowledges that the copyright in all learning content, working materials and accompanying materials provided remains with radiologie-weiterbildung.de GbR. It is prohibited to take screenshots or video captures during the online seminar.
6.2. Working materials are provided digitally. These working materials may not be reproduced or used commercially – not even in part – without the written consent of radiologie-weiterbildung.de GbR and the respective speakers. Where content is provided in digital form (e.g. scripts in PDF format, video and audio recordings), for example by e-mail, streaming or download, participants do not acquire ownership of it. They hold the simple, non-transferable right to use the digital content exclusively for personal use in accordance with copyright law in the manner offered in each case. The digital content may be downloaded and printed once for personal use and copied exclusively to the participant’s own devices. It is not permitted to copy the digital content for third parties, to make it publicly accessible or forward it, to post it on the internet or in other networks for a fee or free of charge, to imitate it, to print it out, to resell it or to use it for commercial purposes, or to alter the content in any way, editorially or otherwise, or to use altered versions.
6.3. radiologie-weiterbildung.de GbR accepts no liability for the content of the online training courses or the accompanying working materials, unless radiologie-weiterbildung.de GbR or one of its vicarious agents is guilty of intent or gross negligence.
6.4. The participant undertakes to refrain from anything that could in any way impair the rights of radiologie-weiterbildung.de GbR.
7. Participation/certificate
7.1. During the online seminar, the participant must be connected both visually and via audio. If either of these connections is not established for reasons for which radiologie-weiterbildung.de GbR is not responsible, no certificate of attendance for obtaining continuing education credits from the competent medical association will be issued. In this case, there is no entitlement to a refund.
7.2. The online training courses are recorded in order to prove continuous participation in cases of doubt. radiologie-weiterbildung.de GbR reserves the right to make the video and audio recordings available to third parties for a fee or free of charge; however, attendance lists, chat content and other personal data of the participants will not be passed on.
7.3. The participant undertakes neither to use personal data of other participants of which they may become aware in connection with the online seminar for commercial purposes nor to make such data accessible to third parties. In the event of misuse, radiologie-weiterbildung.de GbR reserves the right to take legal action.
7.4. After complete and successful completion of the online seminar, the participant receives a certificate of continuing education, which serves as proof for the competent medical association.
7.5. As a rule, the online training courses of radiologie-weiterbildung.de GbR are suitable for the mandatory continuing medical education of physicians. The relevant online training courses are specially marked. The final decision on recognition rests with the competent medical association.
8. Right of withdrawal, electronic withdrawal function
8.1. Consumers within the meaning of Section 13 of the German Civil Code (BGB) have a statutory right of withdrawal in accordance with Sections 312g and 355 BGB when concluding a distance contract. Before the contract is concluded, the consumer is informed separately about the conditions, time limits and procedure for exercising the right of withdrawal and about the legal consequences of withdrawal; the Withdrawal Policy forms part of the contract.
8.2. The withdrawal requires no justification and can be declared in text form (e.g. letter, fax or e-mail) or – without prejudice to other options – by means of the electronic withdrawal function at www.school-of-radiology.com (“Withdraw from contract” button).
8.3. The withdrawal function enables the consumer to submit a declaration of withdrawal stating their name, the details identifying the contract they wish to withdraw from and the electronic means of communication (e.g. e-mail address) to which the acknowledgement of receipt is to be sent, and to send it after checking and confirming the details by means of the confirmation function (“Confirm withdrawal”).
8.4. After activating the confirmation function, the consumer will receive without delay an acknowledgement of receipt on a durable medium (usually by e-mail), which contains at least the content of the declaration of withdrawal and the date and time of its receipt. The declaration of withdrawal is deemed to have been received in good time if it was sent via the withdrawal function before the withdrawal period expired.
8.5. In the event of an effective withdrawal, the contract will be unwound in accordance with the statutory provisions (Section 357 BGB); participation fees already paid will be refunded without delay, at the latest within 14 days of receipt of the declaration of withdrawal, using the same means of payment that was used for the payment.
8.6. The provision of the withdrawal function does not create a right of withdrawal beyond the statutory time limits; contracts can only be withdrawn within the applicable statutory time limits.
9. Dispute resolution
radiologie-weiterbildung.de GbR is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
10. Data protection/data storage
radiologie-weiterbildung.de GbR processes data on the legal basis of Article 6 GDPR. Participant data in the form of names, addresses and communication data of the place of residence or business are stored in machine-readable form and processed within the scope of the purpose of the existing contractual relationship. Radiologie Weiterbildung GbR guarantees that the data transmitted by the participant will be treated confidentially and stored exclusively for its own purposes. In particular, this data will in no way be transmitted to unauthorised third parties for commercial purposes.
11. Place of performance, place of jurisdiction, applicable law, severability clause
11.1. The place of performance is Bamberg.
11.2. To the extent permitted by law, the place of jurisdiction is Bamberg.
11.3. German law applies to all legal relationships between radiologie-weiterbildung.de GbR and the participant, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
11.4. Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the economic purpose of the invalid provision. The same applies to any gap in this contract.
11.5. These General Terms and Conditions shall be drawn up in German and in English. In the event of any discrepancies, the German version takes precedence.
