General terms and conditions of radiologie-weiterbildung.de GbR for online training courses

1. Offer

1.1. Radiologie-weiterbildung.de GbR provides the members of the medical associations, their employees and persons professionally involved in medical matters (hereafter referred to as participants) with further training and certification courses in the context of online continuing education in accordance with the following General Terms and Conditions.

1.2. Online training courses are carried out by means of remote data transmission over the Internet at a fixed time (date, time, duration) with the equal presence of moderators, speakers and participants.

2. Conclusion of the contract

2.1. You can register via our webshop at www.school-of-radiology.com. In special cases, applicants can register by letter or email; the decision regarding this will be made by radiologie-weiterbildung.de GbR. Registrations are binding even if the confirmation of registration is not received or is not received in time. The participant will be informed immediately if there is an overbooking.

2.2. Upon receipt of the registration, the participant will immediately receive a confirmation of registration and an invoice for the participation fee from radiologie-weiterbildung.de GbR. To settle the invoice amount, the participant may select from a number of online payment options. The chosen online payment system will withdraw the amount from the participant’s account. Payment via classic bank transfer is reserved for exceptional cases; radiologie-weiterbildung.de GbR decides on this. In this case, radiologie-weiterbildung.de GbR will bill the participant via email. The invoice amount, stating the invoice number and the participant’s name, must be credited to the account specified in the invoice in full no later than two weeks before the seminar day. For short-term seminar registrations, the payment of the invoice is due immediately.

3. Prices

3.1. The listed prices are the gross prices.

3.2. The telecommunication costs and Internet costs incurred by the participants themselves are not included in the prices.

4. Program change/cancellation

4.1. We reserve the right to make necessary changes to the program, e.g. in the event of illness of a speaker or due to unforeseen events.

4.2. The radiologie-weiterbildung.de GbR reserves the right to cancel the online seminar due to insufficient demand or number of participants at the latest 10 days before the event date or for other good reasons for which radiologie-weiterbildung.de GbR is not responsible, such as the sudden illness of the speaker or force majeure. In this case, seminar fees already paid will be refunded. All additional claims and compensation for damages that do not concern the injury of life, body or health, are excluded as far as there is no willful misconduct or gross negligence on the part of radiologie-weiterbildung.de GbR.

5. Access to the online seminar

On the day of the webinar at the latest, the participant receives the login link to the online seminar by email. The authorization access may not be passed on to third parties, is not transferable and may not be used for multiple logins. Access to the online seminar will only be activated on the day of the online seminar. The participant must meet the technical requirements necessary for participation in the online seminar. Radiologie-weiterbildung.de GbR does not guarantee good transmission quality for live online trainings.

6. Rights/documents

6.1. The participant fully accepts that radiologie-weiterbildung.de GbR retains all ownership rights to all instructional materials, work tools, and supporting materials. It is forbidden to take screenshots or video captures during the online seminar.

6.2. Working documents must be made available digitally. These working documents may not be reproduced or used commercially – even in part – without the written consent of radiologie-weiterbildung.de GbR and the respective speakers. Participants do not acquire ownership of any digital content that is made public, such as scripts in pdf format, video, and audio recordings and, for example, by emailing, streaming, or downloading. They hold the simple, non-transferable right to use the digital content for exclusively personal use in accordance with copyright law in the manner offered in each case. The digital content may be downloaded and printed out once for personal use and copied exclusively to the user’s own devices. It is prohibited to copy, make publicly available or forward the digital content to third parties, to post it on the Internet or on other networks, whether for a fee or free of charge, to copy it, print it, resell it or use it for commercial gain. It is also prohibited to alter the content in any way in terms of content or editorial content or to use modified versions.

6.3. Radiologie-weiterbildung.de GbR assumes no liability for the contents of the online training courses or the accompanying working documents, provided that there is no intentional or grossly negligent fault on the part of radiologie-weiterbildung.de GbR or a subcontractor of radiologie-weiterbildung.de GbR.

6.4. The participant undertakes to refrain from anything that could in any way infringe upon the rights of radiologie-weiterbildung.de GbR.

7. Certificate of Participation

7.1. The participant must be connected both visually and via audio connection during the online seminar. If one of these two connections is not established without the radiologie-weiterbildung.de GbR being responsible for this, no certificate of participation is granted for continuing education credits from the appropriate medical association. There is no obligation for a refund in this case.

7.2. In case of any doubt, the online training courses are recorded in order to prove continuous participation. Radiologie-weiterbildung.de GbR reserves the right to make the video and audio recordings available to third parties free of charge or for a fee, but attendance lists, chat content and the participants’ other personal data are not shared.

7.3. The participant agrees not to use any personal information about other participants that they may learn about in connection with the online seminar for commercial purposes or make it available to third parties. In the event of misuse, radiologie-weiterbildung.de GbR reserves the right to take legal action.

7.4. After successful completion of the online seminar, the participant will receive a certificate of continuing education, which will serve as proof for the relevant medical association.

7.5. As a rule, the online continuing education courses of radiologie-weiterbildung.de GbR are suitable for mandatory continuing education for physicians. The corresponding online training courses are specially identified. The final decision on accreditation is reserved for the relevant medical association.

8. Arbitration

Radiologie-weiterbildung.de GbR is neither willing nor required to participate in a dispute settlement process before a consumer arbitration board.

9. Data protection/data storage

Data is processed by radiologie-weiterbildung.de GbR on the legal basis of Article 6 GDPR. The subscriber data is stored in machine-readable form as name, address and contact information of the place of residence or business address and is processed in accordance with the purposes of the existing contractual relationship. Radiologie Weiterbildung GbR guarantees that the data transmitted by the participant will be treated confidentially and stored exclusively for its own purposes. In particular, this data will not be transmitted in any way to unauthorized third parties for commercial purposes.

10. Place of performance, place of jurisdiction, applicable law, severance clause

10.1. The place of performance is Bamberg.

10.2. The place of jurisdiction is, to the extent permitted, Bamberg.

10.3. All legal relationships between radiologie-weiterbildung.de GbR and the participant are governed by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

10.4. Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes as close as possible to the economic sense and purpose of the invalid provision. The same applies in the event of a loophole in this contract.

10.5. These General Terms and Conditions shall be drawn up in German and in English. In the event of any discrepancies, the German version takes precedence.
